SANTA MONICA, CALIFORNIA (January 18, 2019) – A man from Lynwood identified as Ronnie Solomon has tragically died in a Metro Expo Line Train accident at the 17th Street Train Station.

Santa Monica authorities are saying at the accident took place on Tuesday around 8:30 a.m. Police think that Ronnie Solomon may have been attempting to board the train at the time that the accident took place.

Despite lifesaving efforts the victim tragically died due to his injuries. Authorities temporarily closed the 17th Street Train Station as they continued to investigate.

Liability In Train Accidents

Train stations have a responsibility to maintain their premises in a reasonably safe manner and to take steps to avoid accidents. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself. […] The extent of liability in these cases is defined by the Title on Compensatory Relief.”

If a train station is not maintained adequately a person could slip or otherwise be seriously injured by an incoming train. For example, in Cuthbertson v. LACMTA the Los Angeles County Metropolitan Transportation Authority was found responsible  after a man died while trying to board a train. It was determined that the accident was caused by a lack of protective barriers between rail cars. The family of a victim that dies in an accident with an Metro Expo Line Train Station may be able to seek justice by filing a claim through California’s Code of Civil Procedure 377.60. Premises liability claims can be extremely complex when a train station is involved. An experienced premises liability attorney can evaluate all of the specific facts of your case and let you know what your rights are.
