Liability In Truck Accidents
Trucks are considered common carriers under the law. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].”
If the truck driver was working at the time of the collision their employer may face civil liability. Companies are typically responsible for the negligent conduct of their drivers. Any person that is injured may have the ability to recover damages through a bodily injury claim. A motorcycle accident lawyer can examine all of the unique facts of your case and let you know what your rights are.
