Liability In Motorcycle Accidents
Motorcyclists are typically at a greater danger for being seriously injured in a car accident. They have less protection than drivers in passenger cars and SUVs. Their decreased profile also means that a number of drivers will overlook them while moving. This is particularly problematic when drivers are making left turns.
According to the California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Unless a driver had a green arrow while making a left turn they will typically be held at fault. Any person that is injured by a driver making a left turn may be able to recover damages through a personal injury claim. Damages can include money for lost wages, medical bills and pain and suffering. A motorcycle accident attorney can evaluate the specific facts of your case and let you know if you have a claim that can be pursued.
