Liability In Horse Accidents
Animal owners have a legal responsibility to monitor their animals in order to avoid causing accidents. California Courts have held that horses are considered “inherently dangerous.” This means that there are certain risks that are likely to happen when riding a horse including being kicked, bitten or falling from the saddle. As such, horse riders assume a certain probability of injury when riding or taking care of a horse.
A bystander, however, typically doesn’t assume any risk if they are attacked or kicked by a horse. Depending on a number of factors, liability in such an accident may extend to a:
- Horse owner
- Property owner
- Riding club or stable
Any person that is injured in an accident with a horse may be able to recover damages through a bodily injury claim. Damages in a civil claim can include money for lost wages, medical bills and pain and suffering. A personal injury attorney can examine all of the facts of your case free of cost and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case.
