Liability In Pedestrian Accidents
Drivers have a common law duty to obey the rules of the road and to operate their vehicles in a safe manner. Most pedestrian accidents take place when drivers are distracted or speeding. In fact, it has been estimated that nearly 50% of fatal accidents involved drivers that were either intoxicated or distracted. Police generally use traffic cameras in order to determine liability.
In the absence of traffic cameras there are a number of other methods that police can use in order to determine what happened before an accident. For example, accident reconstruction teams can use forensics in order to recreate the circumstances that led up to a crash. A car accident attorney can conduct an investigation into your case and let you know if you have a claim that can be pursued.
