Amazon Prime Delivery Van Involved In Car Accident With Alameda County Fire Department truck At The Intersection Of Channel Street and Via Lucas

SAN LORENZO, CALIFORNIA (March 3, 2019) – An Amazon Prime delivery van was struck by an Alameda County Fire Department truck at the intersection of Channel Street and Via Lucas.

San Lorenzo police are saying that the two vehicles collided around 3:50 p.m. The fire department truck was on its way to a nearby hospital when it hid the side of the Amazon Prime van and flipped it over.

A second Amazon prime van came to pick up the packages for the van that became disabled. It remains unclear how badly injured the driver of the van was.

An investigation into the cause of the accident remains ongoing at this time.

Liability In Car Accidents With Emergency Vehicles

Emergency vehicles that are responding to an emergency are allowed to break road traffic laws in numerous ways. The driver has the discretion to speed and proceed through intersections without stopping, but still must use caution in order to avoid accidents. However, emergency vehicles like fire trucks, police cars and ambulances must engage their lights and sirens on. This serves as a warning for other drivers.

According to California Vehicle Code 21055, “The driver of an authorized emergency vehicle is exempt from Chapter 2 (commencing with Section 21350), Chapter 3 (commencing with Section 21650).” When authorized emergency vehicles are not using their lights and sirens during an emergency they are held to the same standard of care as other vehicles. Based on Grant, supra, 50 Cal.App.3d at p. 289, “Where the driver of an emergency vehicle responding to an emergency call does not give the warnings prescribed by section 21055, the legislative warning policy expressed in that section dictates the conclusion [that] the common-law standard of care governing his conduct does not include a consideration of the emergency circumstances attendant upon his response to an emergency call.”

Any person that is injured in a car accident with an emergency vehicle may have the ability to file a claim for damages. If that person was working at the time of the accident, they may have the ability to seek aid through worker’s compensation in addition to a personal injury claim. A car accident attorney can investigate your case free of charge and let you know what your options are. Failing to act within the statute of limitations of an accident may prevent you from being able to file a claim down the road.
