Two People Injured In San Leandro Accident At Marina Park After 40-Foot Cottonwood Tree Fell On Them During The FESCO Shuffle Walk Fundraising Event

SAN LEANDRO, CALIFORNIA (April 9, 2019) – Two people were injured when a 40 foot tall cottonwood tree in Marina Park fell on top of them during the FESCO Shuffle Walk Fundraising Event.

San Leandro authorities are saying that the accident took place at Marina Park around 9:52 a.m. Two adults had to be transported to the hospital in order to receive treatment for their injuries.

The walk is meant to help the homeless. It remains unknown at this time why the tree fell. The accident comes after heavy rain in the Bay Area.

Liability In Tree Falling Accidents

Though falling tree accidents may seem like “freak occurrences.” Around 100 people are killed every year in accidents with falling trees. Thousands more are seriously injured every year. Depending on the facts of any case, there may be liability on a property owner for a falling tree. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”

If a tree is in a public park, the city in which it belongs will typically be responsible for it. Trees simply don’t fall over at random. These events are predictable and usually the sign of decay, rot or damage to the tree itself. City officials should hire a certified arborist periodically and have them inspect the trees on their property. There are a number of signs associated with a tree that is in a dangerous condition:

  • Holes in the trunk
  • Missing bark
  • Dead branches
  • Leaning trunk
  • Lost leaves
  • Rotten roots
  • Tight branch growth

Any person that is injured in an accident with a falling tree may be able to recover damages through a bodily injury claim. Damages can include money for lost wages, medical bills and  pain and suffering. A premises liability attorney can work on your behalf and and help you get the medical and financial support that you need to recover. It doesn’t cost anything to hire an attorney and they only get paid for successfully resolving your case.
