California Highway Patrol are saying that the accident took place around 9:20 a.m. According to eye witnesses, the big rig truck was stopped as the lead vehicle while waiting to make a left turn onto the Hesperian Boulevard on-ramp.
Gregory Ott pulled in front of the truck before the light turned green. The 21-year-old big rig truck driver then began turning and hit the back of the victim’s motorcycle.
Authorities are saying that the truck driver may not have been aware that the motorcyclist was next to him. An investigation into the San Leandro truck accident remains ongoing at this point.
Truck Accident Causes
According to the Federal Motor Carrier Safety Administration (FMCSA), there are around 141,000 truck accidents every year. This leads to nearly 4,000 fatalities and tens of thousands of serious injuries. Here are the top 5 factors associated with truck accidents according to the FMCSA:
- Inadequate surveillance
- Over-the-counter drug use
- Required to stop before crash
- Roadway problems
Younger truck drivers tend to lack the experience needed to operate their vehicles safely in difficult situations. There may be multiple sources of liability for any accident involving a semi-truck. A truck accident attorney can take steps to investigate all of the unique facts of your case and let you know what your options are.
Liability In Truck Accidents
Truck drivers have a responsibility to operate their vehicles in a very safe manner in order to avoid accidents. They need adequate rest in order to prevent fatigue and periodic medical exams to ensure they are healthy enough to drive. A number of accidents occur when truck drivers fail to scan their surroundings before making left turns. According to the California Vehicle Code 21801:
“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Trucks make wide left turns and truck drivers are supposed to keep an eye out for other drivers. Motorcyclists are fairly small and they are often overlooked by drivers. When a truck driver hits another vehicle from behind that is fairly strong evidence that they were traveling too quickly or not paying attention. If a truck driver was working at the time of an accident, the company that they work for may face liability through the doctrine of Respondeat Superior. In short, companies are responsible for the negligent conduct of their employees who are working within the course and scope of their employment.
The family of a victim that dies in a truck accident may have the ability to seek justice through a wrongful death claim. A victim’s next of kin has a legal right to seek damages including lost wages, funeral costs, emotional trauma and loss of love. A truck accident attorney can investigate your claim and let you know if a truck driver was negligent prior to a collision.
