Tuyen Vu San Jose: 78-Year-Old Pedestrian Identified As Tuyen Vu Died In Car Accident After Being Hit By Pickup Truck Making Left Turn Near Montecito Vista Way and Montecito Vista Drive 

SAN JOSE, CALIFORNIA (March 19, 2019) – A 78-year-old pedestrian identified as Tuyen Vu has tragically died in a car accident when he was hit by a 2014 Ford pickup truck making a left turn.

San Jose police are saying that the accident took place around 9:00 a.m. by the intersection of Montecito Vista Way and Montecito Vista Drive. Police are saying that the driver of the pickup truck hit Tuyen Vu as he was in the crosswalk.

The driver was making a left turn at the time of the accident. He remained at the scene and cooperated with authorities.

Liability In Pedestrian Collisions

“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

To the greatest extend possible, cities should design, construct and maintain roads that are reasonably safe for pedestrians. According to California Government Code 835, cities and state agencies may be liable for a “dangerous condition on public property.” Whether an intersection is in a “dangerous condition” will depend on a number of factors. Generally speaking, when there is a history of accidents at a particular location that is indicative that there is a safety problem that needs to be corrected.  

One of the easiest way to protect pedestrians is to create protected left turn signals. Drivers are normally distracted when they are making left turns because they are looking out for oncoming traffic. Protected left turns allow drivers to focus better and make sure that they don’t hit pedestrians.
