Liability In Pedestrian Accidents
Nearly 35,000 people are killed ever year in car accidents across the United States. Many of these accidents occur because drivers are not paying attention to the road head of them. Drivers must do everything in their power to avoid hitting pedestrians even if they are outside of crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” The family of any person that dies in an accident may be able to seek justice through a wrongful death claim.
