Liability In Hit-And-Run Accidents
Drivers are supposed to remain at the scene of an accident. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that choose to flee the scene of an accident are likely to face civil as well as criminal liability.
The family of a victim that dies in a car accident is protected by a number of laws. For example, a hit-and-run driver can be held civilly liable under California Code of Civil Procedure 377.60. Damages in a wrongful death claim can help cover funeral expenses, lost wages and loss of love. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. There are statute of limitations associated with being able to pursue a claim so it’s important to act quickly.
