Liability In Pedestrian Accidents
According to the National Highway Traffic Safety Administration, nearly 5,000 pedestrians are killed every year in the United States. Another 76,000 are injured. When a driver violates a safety-related statute and hits a pedestrian the victim or their family will be able to pursue a negligence claim against the at-fault driver’s insurance. Damages may include lost wages, medical bills and pain and suffering. Depending on the facts of any case, a victim or their family may be able to pursue a municipal negligence claim against the city where the accident took place.
According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred.” In short, cities have a responsibility to design roads that are reasonably safe and free from defects that could cause an accident. It’s important to seek the legal guidance of an experienced pedestrian accident attorney if you or someone that you love has been involved in an accident. There are statute of limitations associated with being able to file a claim, so it’s important to act quickly.
