Liability In Assaults At Living Centers
Property owners have a legal responsibility to keep their guests reasonably safe. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
This includes taking steps to help protect guests from violent activity and assaults. The level of security or safety measures needed at a particular location will vary depending on a number of factors. Property owners could be held liable for one guest attacking another guest if they showed deliberate indifference to that guest’s safety. Deliberate indifference may occur if a property owner had specific knowledge of particular threats and failed to act.
The family of any person that died due to an assault at a living center may have legal recourse under California Code of Civil Procedure 377.60. Damages in a wrongful death claim may include compensation for lost wages, medical bills and loss of love. A wrongful death attorney can examine all of the facts of your case and let you know what your legal rights are. An attorney can also let you know if a property owner was negligent.
