San Francisco Truck Accident: 47-Year-Old Man Seriously Injured After Being Dragged By Truck Downtown Near First Street And Howard Street

SAN FRANCISCO, CALIFORNIA (March 6, 2019) – A man has been arrested after he hit a pedestrian with his truck in downtown San Francisco and dragged him for one block by First Street and Howard Street.

San Francisco police officials are saying that the accident took place around 10:27 p.m. A large box truck hit the victim, pinned him underneath the truck and then dragged him for a while.

The victim was taken to the hospital in serious condition, but is currently listed as stable. The 40-year-old driver of the box truck was arrested at the scene.

An investigation into the cause of the accident remains ongoing at this time.

Liability In Truck Accidents

Truck drivers are considered “common carriers” under the law. Drivers are expected to drive with the vigilance of a “very cautious person.” According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” San Francisco in particular can be a dangerous place for pedestrians.

The city is filled with hills and there are a number of streets with heavy pedestrian traffic. Truck accidents tend to spike when drivers are either fatigued or unfamiliar with the roadways. City officials have sought to implement measures to help reduce the occurrence of pedestrian accidents. Vision Zero is the plan that the city has in place to eventually eliminate pedestrian fatalities. This will be done through (1) education, (2) engineering, (3) enforcement or (4) evaluation.

Any person that is injured in a pedestrian accident in San Francisco may be able to recover damages through a bodily injury claim against the negligent driver. Depending on the facts of any case there may be municipal liability for an accident if it was caused by a dangerous condition on public property. A pedestrian accident attorney can evaluate all of the facts of your case and let you know if you have a claim that can be pursued.
