Liability In Pedestrian Accidents
Drivers are supposed to keep an eye out for pedestrians and take steps to avoid causing accidents. But far too often drivers are distracted or speeding. The University of California Berkeley has created an interactive map that shows streets that have a history of pedestrian collisions. According to UC Berekely, “The Transportation Injury Mapping System (TIMS) has been developed over the past five-plus years by SafeTREC to provide quick, easy and free access to California crash data, the Statewide Integrated Traffic Records System (SWITRS), that has been geo-coded by SafeTREC to make it easy to map out crashes.”
According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Any victim that is injured in a pedestrian accident may have recourse through a bodily injury claim. A car accident attorney can investigate your claim free of charge and let you know what your options are.
