Liability In Muni Stop Attacks
Cities have a responsibility to take steps to make sure that their premises are in a reasonably safe condition. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
This includes taking reasonable measures to help deter and prevent crime. There are a number of steps that a city or company can take to help reduce the likelihood of violent crime. Cameras, adequate lighting and security guards can all help keep guests safe. The level of security needed at a certain location will depend on a variety of factors. Locations with a history of crime will typically need more security. Any person that is injured in an attack may have the ability to recover damages through a bodily injury claim. A premises liability attorney can examine all of the facts of your case and let you know what your rights are.
