Liability in Pedestrian Accidents
According to the NHTSA, around 59,000 pedestrians are injured every year in the United States. This number has gradually decreased over time as safety improvements in cities have been made. Most accidents tend to take place between 6:00 p.m. to 9:00 p.m. According to the California Civil Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
A number of accidents occur when drivers fail to yield the right of way to pedestrians. Any pedestrian that is injured by a negligent driver may have the ability to pursue a bodily injury claim for damages. Damages may include financial compensation for lost wages, medical bills and pain and suffering. A pedestrian accident attorney can take steps to make sure that you are taken care of after an accident.
