Liability In Elevator Accidents

Businesses have a legal responsibility to take steps to prevent accidents.  According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” But liability may also extend beyond a business owner.

Generally speaking, companies outsource the installation and repair of their elevators. If a company fails to install or repair an elevator correctly this could lead to an accident. Other common causes of elevator accidents will include:

  • Pulley system malfunctions
  • Mechanical breakdowns of the elevator
  • Faulty wiring
  • Unbalanced leveling / failure of elevator lining with floor

Any person that is injured in an elevator accident may be able to file a claim for damages. Damages can include money for lost wages, medical bills and pain and suffering. It’s important to seek medical treatment after an elevator accident. Many victims of elevator accidents may not even realize the full extent of their injuries until several weeks or months later. A San Diego premises liability attorney can investigate all of the facts of your case and let you know what your legal options are.
