Three People Injured In San Diego Tour Bus Accident On Interstate 805 Freeway In Sorento Valley

SAN DIEGO, CALIFORNIA (May 26, 2019) – Three people were hospitalized after a bus accident on the I-805 freeway in Sorento Valley.

California Highway Patrol are saying that the accident took place around midnight. A tour bus filled with tourists was unable to slow down with stopped traffic and rear-ended a white sedan.

The force of the collision pushed the white sedan into the back of a black SUV. CHP officials are investigating the source of the crash.

Liability In Tour Bus Accidents

Bus companies are considered “common carriers” under the law. As such, they are held to a very high standard in terms of safety. According to Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” There are a number critical factors associated with bus accidents including:

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Required to stop before crash (traffic control device, crosswalk)
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

Fatigue, in particular, is the number one cause of major injury bus accidents. Bus drivers may not realize traffic ahead of them has slowed down or stopped. A rear end collision may occur. There is simply no excuse for this. Bus drivers are supposed to maintain a safe distance with the vehicle ahead of them.

Any person that is injured in a bus accident may have the ability to recover damages. Many victims may not realize the full extent of their injuries until several weeks or months after an accident. It’s important to seek medical attention and make sure that your injuries are properly documented. A bus accident attorney can examine all of the facts of your case and let you know what your options are.
