SAN DIEGO, CALIFORNIA (April 16, 2019) – A 32-year-old inmate identified as Michael Richard Wilson was the fourth person to die in a San Diego jail in recent weeks.
Authorities said that Michael Richard Wilson succumbed to heart failure inside his cell at the Front Street Detention Center. San Diego authorities said that the inmate was taken to the hospital but died shortly thereafter.
A full investigation into the cause of the death remains ongoing at this time.
Liability In Inmate Deaths
Jails and detention centers have a constitutional duty to provide inmates with reasonably adequate healthcare. But this right is not always respected. According to the NCBI, “Currently, nearly 2.3 million US inmates (about 1% of US adults) must rely on their jailers for health care. Although prisoners have a constitutional right to health care through the Eighth Amendment’s prohibition of “cruel and unusual” punishment, periodic scandals, as well as previous studies, indicate that prisoners’ access to health care and the quality of that care are often deficient.” One of the major problems facing our criminal justice system is counties outsourcing inmate care to third-party for-profit companies.
In many situations, for-profit companies are more concerned with getting a return on their money than providing inmates with good care. Courts have generally held that when a county is “deliberately indifferent” to the serious medical needs of an inmate they could face civil liability following an inmate’s death. The family of a victim that died may be able to seek justice through California’s Code of Civil Procedure 377.60. A wrongful death attorney can examine the specific facts of your case and let you know what your options are. There are statute of limitations associated with being able to pursue a claim so it’s important to act quickly.
