Liability In Bus Accidents

Bus drivers have a responsibility to take steps to prevent accidents. Unfortunately, bus drivers can become fatigued or distracted and this may lead to a crash. According to the FMCSA there are 10 major factors associated with bus accidents:

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Required to stop before crash (traffic control device, crosswalk)
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

If a bus driver was negligent in an accident, the company or county that they work for may face vicarious liability. A victim would be able to recover damages for lost wages, medical bills and pain and suffering. Psychological trauma including PTSD is actually fairly common following a major accident. A bus accident attorney can investigate your case free of cost and let you know what your options are.
