Liability In Accidents Involving Falling Tree Branches
Cities have a legal responsibility to maintain their premises in a reasonably safe manner and take steps to avoid causing accidents. ?According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes taking measures to prevent accidents involving falling trees or branches.
Accidents involving falling trees or branches may seem like a freak occurrence, but they are actually quite predictable. City officials must do periodic inspections of the trees on their property. They should look for signs of insects or disease that could weaken the structural integrity of the tree. If city officials fail to do inspections or to remove trees that are in a dangerous condition they may face civil liability in the event of an accident.
Any person that is injured in an accident with a falling tree branch may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, cities will often work hard to deny liability if anyone gets injured by a falling tree branch. A premises liability attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
