Eric Findley San Diego: Motorcyclist Eric Findley Died In Car Accident After He Was Hit By Pickup Truck Making Left Turn
SAN DIEGO, CALIFORNIA (January 1, 2018) – A motorcyclist identified as Eric Findley has tragically died in a car accident after he was hit by a pickup truck making a left turn into a parking lot by West Bernardo Drive.
San Diego police officers are saying that the accident took place around 11:24 a.m. A man driving a 2013 Dodge Ram Pickup made a left turn into a parking lot directly into the path of the victim.
The pickup collided with Eric Findley and he was thrown off his motorcycle. San Diego Fire Department officials arrived at the scene and pronounced him dead.
Alcohol is not believed to have played a role in the crash.
Liability In Left-Turn Accidents
Drivers have a common law duty to operate their vehicles in a reasonably safe manner and to take steps to avoid accidents. Drivers attempting to turn left should yield the right of way to oncoming traffic. According to the California Vehicle Code 21801, “(a) The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Unfortunately, a number of drivers continue to make illegal and dangerous left turns. Motorcyclists are particularly at risk for these types of accidents because drivers have a harder time seeing them. The family of a person that died in a left-turn accident will have the ability to file a wrongful death claim against the negligent driver. Depending on the facts of any case, there may also be liability on the part of a city if a defect in a roadway caused the accident. It’s important to seek the legal guidance of an experienced motorcycle accident attorney after a collision. An attorney can examine your case free of charge and let you know what your rights are.
