Liability In Tire Blowout Accidents
Truck companies are responsible for training their drivers adequately and making sure that their rigs are properly maintained. There are a number of reasons that a tire might blowout including:
- Defects with the tire treads
- Small holes in the tire itself
- Overloading of the vehicle
Overloading can be a particularly dangerous problem for trucks. It can increase the odds of both brake failure and tire blowouts. According to FMCSA regulations, a truck’s gross weight limit should not exceed 80,000 lbs. A blowout may also occur due to chemical bonding defects with the tire itself.
Any person that is injured in a truck accident due to a tire blowout may be able to recover damages through a bodily injury claim. Damages can include financial compensation for lost wages, medical bills and pain and suffering. A truck accident attorney can investigate all of the facts of your case and let you know if you have a claim that can be pursued.
