SAN DIEGO, CALIFORNIA (June 6, 2019) – A 52-year-old man was seriously injured in a scooter accident not far from the intersection of West Broadway and Pacific Highway.
California Highway Patrol are saying that the accident took place around 1:40 a.m. The man was apparently traveling north when he hit a bump in the sidewalk and lost control of his scooter before crashing.
The scooter accident victim sustained major injuries to his head, face and neck. He was transported to the hospital by paramedics.
Liability In Scooter Accidents
Scooter accidents have become increasingly common in San Diego, Los Angeles and the Bay Area. Companies like Lime and Bird have flooded the market with relatively inexpensive scooters that anyone can ride for a small fee. Many scooter riders are injured due to the negligence of other drivers who are speeding or making dangerous left turns. But driver error is not the only source of potential negligence in scooter accidents.
A city may face civil liability for a scooter accident if it was caused by a dangerous condition on public property. According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition.” For example, a sidewalk could be uneven and cause a scooter rider to fall over.
Any person that is injured in a scooter accident may have legal recourse through a bodily injury claim. Damages can include money for lost wages, medical bills and pain and suffering. Scooter accidents often leave victims with serious and life-long injuries. For example, even a moderate traumatic brain injury can leave victims with medical costs well over $500,000. A scooter accident attorney can examine all of the facts of your case and let you know what your legal options are.
