San Diego Scooter Accident: 46-Year-Old Man Injured In Scooter Accident Along Rosecrans Street In The Midway Portion of San Diego
SAN DIEGO, CALIFORNIA (March 4, 2019) – A 46-year-old man suffered a broken leg in Midway along Rosecrans Street after being hit by pickup truck.
San Diego police officials are saying that the accident took place around 10:25 p.m. The driver of a Ford pickup truck had just finished making a left turn and hit the scooter rider.
Paramedics arrived at the scene and transported the injured scooter rider to the hospital. It does not appear that the pickup truck driver was cited for the accident.
Liability In Scooter Accidents
Drivers in California have a common law duty to operate their vehicles in a reasonably safe manner and keep an eye out for pedestrians. This is especially important when a driver is making a left turn. According to California Vehicle Code, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Drivers that fail to yield the right of way to pedestrians when making a left turn are likely to face civil liability in the event of an accident. Any person that is injured in a car accident can file a claim for damages. Damages may include money for hospital bills, subsequent medical care, lost wages and pain and suffering. The psychological impact of serious injury accidents can last well after a person has healed physically. A scooter accident attorney can take steps to make sure that you are fairly compensated for all of your injuries.
