Liability In Garbage Truck Accidents
It has been estimated that there are over 120,000 truck accident crashes that take place every year. This results in over 5,000 fatalities and tens of thousands of serious injuries. The FMCSA has listed a number of potential causes of trash truck accidents including:
- Brake problems
- Roadway problems
- Prescription drug use
Private garbage trucks, in particular, can be especially dangerous. According to one study by ProPublica, private garbage truck companies have been more likely to work drivers to exhaustion and encourage speeding. A number of drivers work 10 – 14 hour days 6 days a week.Even when a driver is fully rested, garbage trucks can be very difficult to operate.
As you can see in the image above garbage trucks have unusually large blind spots on their sides. A motorcyclist or even a car could completely disappear. A good trash truck driver should check their blinds spots, but this does not always happen. Accordingly, a number of collisions take place as drivers are trying to pass other vehicles. Victims of garbage truck accidents are often left with very serious injuries including:
- Head injuries
- Back injuries
- Road rash
- Spinal cord injuries
- Broken bones
If a garbage truck driver hits a motorcyclist and causes an accident the company or city that they work for may face civil liability for their actions. Generally speaking, employers are held liable for the negligent conduct of their employees – insofar as the employee was working within the course and scope of their job duties.
Any person that is injured in a motorcycle accident with a garbage truck may have legal recourse through a bodily injury claim. Damages in a civil claim can include money for lost wages, medical bills and pain and suffering. Victims of garbage truck accidents may not even realize the full extent of their injuries until several months later. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
