Liability In Hit And Run Accidents
Whether a driver is at fault or not they are expected to stop after an accident. Unfortunately, a number of fatal pedestrian accidents are caused by drunk drivers. According to Mothers Against Drunk Driving, “In 2017, 9 percent of all drivers involved in fatal crashes during the day were drunk, compared to 32 percent at night. In addition, almost twice as many alcohol-related traffic fatalities occurred during the weekends compared to weekdays.”
Drivers that flee the scene of a fatal accident may face criminal as well as civil liability. The family of a victim that dies in a pedestrian accident may have recourse under California Code of Civil Procedure 377.60. A wrongful death attorney can take steps to investigate your claim and hold any negligent drivers accountable.
