Liability In Mall Shootings
All malls have a legal responsibility to keep their premises reasonably safe. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes taking measures to prevent violent crimes.
There are a number of measures that can be taken in order to prevent crime at malls. Proper lighting, video cameras and armed guards can all help keep crime in check. The level of security necessary for any location will vary depending on a variety of different factors. For example, malls that are in high-crime areas will typically need more security than other locations.
Any person that is injured in a mall shooting may have legal recourse through a premises liability claim. Damages in a personal injury claim can help with medical bills, lost wages and pain and suffering. A premises liability attorney can examine your case free of cost and let you know what your options are. There are, however, statute of limitations associated with being able to file a claim so it’s important to act quickly.
