Kevin Clancy San Bernardino: 57-Year-Old Man From Pasadena Identified As Kevin Alan Clancy Died In Semi-Truck Accident On The Route 210 Freeway Not Far From Highland Avenue
SAN BERNARDINO, CALIFORNIA (June 2, 2019) – A 57-year-old man from Pasadena identified as Kevin Alan Clancy was tragically killed in an accident after being hit by a semi-truck on the Route 210 Freeway.
California Highway Patrol are saying that Kevin Alan Clancy was walking along the freeway median around 11:26 a.m. when he was hit.
Authorities are saying that the victim was struck by the 2014 Freightliner tractor trailer that was moving slowly in the No. 1 lane. Police think that Kevin Alan Clancy may have fallen right before he was struck.
Firefighters and paramedics rushed to the scene of the collision in order to help the victim. An investigation into the cause of the semi-truck accident remains ongoing at this time.
Preventing Semi-Truck Accidents
According to one report from the National Highway Traffic Safety Administration, “Deaths from large truck crashes reached their highest level in 29 years in 2017. Large truck fatalities rose 9 percent to 4,761, an increase of 392 lives lost over the prior year. About 1,300 of the deaths were truckers. The remaining 72 percent occurred in the other vehicle involved in the collision.” There are a number of safety measures that can be put in place to help prevent accidents:
- Rest: Believe it or not, fatigue is the number one factor for fatal truck accidents. It’s important that companies make sure that truck drivers get their legally required rest and take breaks.
- Driver Preparation: Drivers should plan their routes and have GPS available to them when routes become difficult. Unfamiliarity with the roadway leads to many truck accidents.
- Move Slowly: Truck drivers are incentivized to complete their routes as fast as possible. But simply slowing down and paying attention to the road ahead could eliminate the majority of accidents.
Truck drivers must have a commercial license and be adequately trained. Pedestrians should also do their best to avoid situations which could lead to accidents. Trucks have large blind spots and a driver making a wide turn may not see a pedestrian in the roadway. Depending on the facts of any case, a truck driver may face liability for an accident.
Liability In Truck Accidents
Truck drivers have a responsibility to scan the road ahead of them and take measures to avoid accidents. Drivers must continue to exercise care even if a pedestrian is in an unmarked crosswalk. According to California Vehicle Code 21950 Subsection (C), “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
Determining liability in a truck vs pedestrian accident can be difficult. It’s important that eye witnesses are sought out. Surveillance footage is also crucial though not available for many accidents. If a truck driver was negligent in causing an accident, they could face civil liability and owe the victim or their family restitution. If the truck driver was working for a company at the time of the accident, that company could face vicarious liability as well.
The family of a victim that died in a truck accident may be able to seek justice through a wrongful death claim. Damages can help cover funeral costs, medical bills, lost wages and emotional trauma. A truck accident attorney can investigate all of the facts of your case and let you know what your legal options are. Unfortunately, trucking companies will often work extremely hard to deny liability following a collision.
