Luke O’Heidhin San Anselmo: Senior at Sir Francis Drake High School Loses Hand In Construction Accident Over Spring Break: Support The Victim Through Go Fund Me
SAN ANSELMO, CALIFORNIA (April 28, 2019) – A senior and 4.0 student at Sir Francis Drake High School in San Anselmo lost his right hand in a construction accident over spring break.
According to a Go Fund Me campaign set up to help the victim, “Luke suffered a devastating loss during his Spring Break while working at a construction site. His right hand was completely severed. His younger brother, Kyle, bravely intervened to save Luke’s hand but unfortunately his hand was too damaged. Our entire family is suffering but we are all thankful he is alive.”
The Go Fund Me campaign has raised $156,610 in order to help with medical expenses not covered by insurance. Luke O’Heidhin’s parents remain optimistic that he will be able to attend one of the colleges that he has been accepted into.
Luke O’Heidhin received reconstructive surgery in San Francisco and he will have better mobility in his wrist. It remains unclear how the construction accident took place.
Liability In Construction Accidents
According to the Centers For Disease Control, “In 2016, 10.3 million U.S. workers were employed in construction, a 16% increase after construction employment bottomed out in 2012.” Falls are the number one leading cause of death and injury at construction sites. But many workers are also injured in accidents with heavy machinery. When a worker is injured on the job they will typically have access to worker’s compensation.
According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” Benefits in a workers compensation claim can help cover:
- Past medical expenses
- Future medical expenses
- Lost wages
In addition to workers compensation claims, an injured worker may be able to pursue damages through a third party liability claim. Third party liability may arise if an entity separate from a worker’s employer was responsible for the accident. For example, if a piece of machinery contributed to an accident the manufacturer of that machine could face liability through a product liability claim. A personal injury attorney can investigate all of the facts of your case and let you know what your options are.
