Samuel Xamuel Lara Died In Accident With Dump Truck While Crossing Intersection In Ukiah at Talmage Road and Hastings Frontage Road
UKIAH, CALIFORNIA (September 19, 2018) – A 34-year-old man identified as Samuel (Xamuel) Lara has tragically died in a dump truck accident after he was hit by the truck as it was turning into an intersection.
Ukiah police are saying that the fatal bicycle accident took place around 1:00 p.m. by Talmage Road and Hastings Frontage Road.
Officials at the Ukiah Police Department are saying that Samuel (Xamuel) Lara and the dump truck owned by Wipf Construction were heading east on Talmage Road.
There was construction on the roadway when the collision took place. The driver of the dump truck said that a flagger gave him the all clear to turn south onto the road.
That’s when the dump truck crashed into the bicyclist leaving him seriously injured. Thankfully, there is video footage by two businesses with cameras pointed at the intersection.
Police were also interested in speaking with any person at the nearby gas station that may have been a witness.
In 2012, another dump truck owned by Wipf Construction was involved in a fatal bicycle crash.
There is currently a Go Fund Me page to help give Samuel (Xamuel) Lara a proper burial.
Bicycle Accident Statistics and Safety Precautions
In 2015, there were 818 bicycle accident deaths involving motor vehicles. Many more people are seriously injured. The U.S. Department of Transportation estimates that around 44,000 bicyclists were injured in motor vehicle accidents in 2015. Injuries associated with bike accidents are estimated to cost nearly 4 billion dollars per year according to the National Safety Council. Cyclists should be especially cautious in urban areas which account for the vast majority (71%) of crash sites. There are a number of measures that you can take to help keep yourself safe when you’re using a bicycle.
Always wear a helmet and make sure it fits properly. Victims that survive bicycle accidents are often left with long-term ailments including traumatic brain injuries.
Make sure your bicycle is equipped with reflectors to help cars see you at night.
Perform maintenance on your bike to make sure that the brakes and other components are working.
Drive with the flow of traffic and use hand signals to help let drivers know your intent.
Even when every safety precaution is met, a bicyclist can still be hit by an inattentive driver. Depending on the facts of any case a victim may have the ability to file a claim in order to recover damages.
Liability In Dump Truck Accidents
There are numerous federal regulations that govern how truck companies can operate. The majority of the federal regulations are located in Title 49 of the Code of Federal Regulations. In addition to federal regulations, every state also has statutes governing truck use within their state. There are a number of potential actors in any given truck accident that may be held liable:
Drivers A truck’s driver is responsible for operating their vehicle in a safe manner. This means driving according to the prevailing conditions of the road and keeping an eye out for pedestrians.
Vehicle Owners Truck owners should make sure that their vehicles are safe and that regular maintenance is performed.
Product Manufacturers Companies that produce tires and other vehicle components need to make sure that those components are safe. Defective truck components regularly contribute to accidents.
Third Parties In Control of The Truck Trucks are regularly leased out to companies that need them. When the lease owner of a truck acts negligently they may face liability following an accident.
It can be difficult to know where to begin if you’ve been involved in a truck accident. An experienced attorney can examine the facts of your case and take steps to preserve key pieces of evidence.
