Liability In Inmate Attacks
Jails and prisons have a legal responsibility to make sure that inmates are reasonably safe. This includes taking measures to help prevent inmates from attacking each other. There are a number of measures that can help reduce the likelihood of violence:
- Security: Prisons should have adequate staff in order to help prevent attacks.
- Searches: Security officers must make sure that inmates aren’t able to smuggle illegal weapons into the prison.
- Cameras: Cameras can be useful in helping to ensure that inmates and security officers are adhering to the rules
If jail officials have specific knowledge of particular threats they should address these issues. Failing to secure inmates from particular threats may show deliberate indifference to the inmates safety. This could open up the door to the inmate or their family being able to file a civil claim.
When an inmate is killed in an attack with other inmates the family of the victim may be able to seek justice through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your options are.
