California Highway Patrol are saying that the accident took place around 2:00 a.m. The driver hit Francisco Rodriguez and left him facedown and unconscious in the street before taking off.

Liability In Hit-And-Run Accidents

According to a report from AAA, “2049 people were killed by hit-and-run crashes in 2016 — a 62 percent increase from 2009, the last year in which a downward trend was recorded. AAA said the data makes 2016 the deadliest year since the National Highway Traffic Safety Administration began compiling statistics on fatal motor vehicle crashes in 1975.” Those that manage to survive are often left with serious injuries.

It is a felony to leave the scene of an accident that causes great bodily injury or death. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that choose to flee the scene of an accident are likely to face criminal as well as civil liability.

Any person that is injured in a car accident may be able to receive damages through a personal injury claim. Damages can include money for lost wages, medical bills and pain and suffering. For example, even a moderate traumatic brain injury can result in life-time medical costs of over $500,000. A pedestrian accident attorney can examine all of the facts of your case and let you know what your rights are.
