Liability In Garbage Truck Accidents
Garbage trucks can weigh as much as 80,000 lbs fully loaded. They are difficult to handle and can be even more difficult to stop. It’s important that garbage truck drivers operate their vehicles according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
There is simply no reason that a garbage truck should ever rear end another vehicle. A good driver should maintain a safe distance with the car in front of them. Even if the lead vehicle brakes suddenly or is completely stopped the following vehicle should be able to break in time. If a truck driver is negligent and causes an accident they may face civil liability for the crash.
Any person that is injured in a garbage truck accident may be able to recover money through a bodily injury claim. This could include compensation for lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your options are. There are time limits associated with pursuing a civil claim. so it’s important to act quickly.
