Idaho State Police are saying that  Samuel Gutierrez Marin from Jerome and German Nava-Zamora from Twin falls were both pronounced dead at the scene. There is an active investigation into the cause of the head-on truck accident at this time.

It remains unclear if the truck driver will face any charges for the crash.

Liability In Head-On Collisions With Semi Trucks

Head-on collisions are by far the most dangerous type of car accident that a person can be involved in. Drivers and passengers are much more likely to be seriously injured or killed in head-on collisions than other types of accidents. The force of the impact is combined from the speeds of both vehicles. Two vehicles of equal weight colliding head-on at 30 mph is equivalent to one vehicle hitting a brick wall at 60 mph. Even low speed impacts can leave victims with horrific injuries.

Liability in head-on collisions can be somewhat difficult to determine. The impact of a crash can send vehicles in totally different directions from where they were originally traveling. Thankfully, forensic engineers and accident reconstruction specialists can determine what happened based on skid marks and other factors. Witnesses, of course, can be crucial as well.

According to the legal principal known as vicarious liability, negligence in a truck accident can extend beyond just the driver. If a truck driver was negligent and working at the time of an accident the company that they were working for could be held liable. However, it’s not uncommon for truck companies to try to deny liability after an accident. This is why it’s so crucial to get the legal guidance of a truck accident attorney. An attorney can take steps to preserve evidence and make sure that your rights are being protected.
