RANCHO CUCAMONGA, CALIFORNIA (July 11, 2019) – A motorcyclist identified as Andrea Olivas has tragically died in an accident after being run over by a Fedex semi-truck on the 210 freeway.

California Highway Patrol are saying that the accident took place around 2:12 p.m. by the I-15 south connector. For reasons that remain under investigation Andrea Olivas fell off of her bike in the middle of the freeway. 

A Fedex semi-truck allegedly ran the victim over after she was ejected from the bike. Firefighteres and paramedics were called to the scene.

Despite life-saving efforts Andrea Olivas  died due to her injuries. The Fedex driver that hit the victim remained at the scene and cooperated. 

Authorities do not believe that the truck driver was impaired at the time of the collision. A Facebook Fundraiser for the victim’s family is scheduled to occur on July 12th. 

Liability In Fedex Truck Accidents

Fedex trucks are considered “common carriers” under the law and held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].”

Truck drivers have long commutes and much of that is on the freeway. It’s easy for drivers to become comfortable and therefore complacent. Truck drivers must always drive according to the prevailing conditions and keep a safe follow distance with the cars and motorcycles ahead of them. According to California Code of Civil Procedure 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” According to the FMCSA, there are three critical events which account for the vast majority of truck accidents: 

  • Running out of the travel lane, either into another lane or off the road (32 percent of the large trucks in the LTCCS sample were assigned this critical event)
  • Vehicle loss of control due to traveling too fast for conditions, cargo shift, vehicle systems failure, poor road conditions, or other reasons (29 percent)
  • Colliding with the rear end of another vehicle in the truck’s travel lane (22 percent).

Even if a vehicle in front of a truck slows down abruptly a good truck driver should be able to decelerate in time and prevent an accident. An electronic data recorder (EDR) is installed on most trucks and keeps a record of a number of important vehicle dynamics. According to the NHTSA, ” EDRs may record (1) pre-crash vehicle dynamics and system status, (2) driver inputs, (3) vehicle crash signature, (4) restraint usage/deployment status, and (5) post-crash data such as the activation of an automatic collision notification (ACN) system.” All of this data can be used to help determine liability after an accident.
