Liability In Pedestrian Accidents
Car accidents can leave pedestrians with serious and lasting injuries. Older adults tend to be at greater risk of pedestrian accidents. According to the Centers for Disease Control, “Pedestrians ages 65 and older accounted for 19% of all pedestrian deaths and an estimated 13% of all pedestrians injured in 2015.” Depending on the facts of any case, the driver or even a city may face civil liability for a pedestrian accident.
A city may be liable for a pedestrian accident if it was caused by a dangerous condition in the roadway. According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” Any person that is injured in a car accident may be able to seek damages through a personal injury claim.
