The pedestrian was transported to the hospital where he was treated for minor injuries. Robert Tockstein then began moving his wife’s vehicle when he was also struck in the crosswalk.
He was transported to the Palomar Medical Center in Escondido where he was later pronounced dead due to his injuries. An investigation into both car accident remains ongoing at this time.
Liability In Car Accidents
There are a number of factors that Poway police should look into as they examine the car accident that killed Robert Tockstein. Pedestrians usually get hit when they are crossing the street and another car stops for them. If there is a green light the next vehicle will keep traveling and may strike the pedestrian. The stopped car blocks the line of sight for the pedestrian as well as the vehicle. In addition to driver negligence there may also be negligence on the part of a city if a dangerous condition in the roadway contributed to it.
An intersection may be in a dangerous condition if it lacks basic safety features like stop signs or street lights. Missing or confusing pedestrian markings regularly contribute to accidents as well. There are engineering and safety standards that cities must adhere to when they build roads. If a person is injured or killed in a pedestrian accident caused by a defect in the roadway victims will have the ability to file a municipal negligence claim for damages. A car accident attorney can investigate the specific facts of your case and let you know what your rights are.
