Liability In Hit And Run Accidents
It is a felony to leave the scene of an accident that results in the injury of another motorist. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.”
In addition to liability on the part of a driver there may also be liability on the part of a city for an accident. According to California Government Code 835, a city may be liable for a collision proximately caused by a dangerous condition on public property. An intersection can be in a dangerous condition if it has unclear lane markings or lacks basic safety features like pedestrian crosswalks.
