PLACERVILLE: Jessica Peterson Injured In Truck Accident On Lotus Road; Victim’s Three Children Also Hospitalized

Sep 26, 2018

Jessica Peterson and Her Three Children Ages 4, 5 and 8 Were Injured After Truck Accident Involving Lexus On Lotus Road In Placerville

PLACERVILLE, CALIFORNIA (September 25, 2018) A 30-year-old woman identified as Jessica Peterson and her three young children were injured in a truck accident on  Lotus Road not far from Sutter’s Mill Elementary School.

Placerville authorities are saying that the accident took place around 7:50 a.m. A man driving northbound of Lotus Road pulled out from Luneman Road and struck the left side of a big rig.

That initial car accident led the tractor trailer truck to fishtail and then hit a Buick Enclave driven by Jessica Peterson. The car also had Jessica Peterson’s three children ages 4, 5 and 8.  Two of the three children had to be taken by helicopter to the UC Davis Medical Center.

A third child was taken by ambulance to the hospital. The names of the children were not released following the big rig truck accident because extended family hadn’t yet been notified.

The truck driver was alert following the collision and was later taken to the hospital after complaining of neck pain. Police cleared Lotus Road by 9:00 a.m. in order to better respond to the crash.

An investigation into the crash that injured Jessica Peterson remains ongoing at this time.

Truck Accident Statistics

A truck accident can occur for any number of different reasons. Texting, fatigue and carelessness continue to be some of the main contributors to these accidents. There has been a general trend upwards of fatal truck accidents since 2008 as the economy has continued to improve. More people have gone back to work and more truck drivers are delivering more goods for more companies. In 2016, a total of 4,400 trucks were involved in fatal collisions.

Arguably, the general upward trend in fatal truck accidents could also be tied to a relaxing of regulations for truck drivers. Truck drivers are able to work more hours and are allowed to take shorter rest breaks before heading back out on the road. It’s easy to see how fatigue can come into play. When a truck driver acts negligently and causes an accident they may face civil liability if anyone is injured or killed. A car accident attorney can evaluate the facts of your case free of charge and let you know what your rights are.

Liability In Truck Accidents

When an accident involving a commercial truck takes place, liability is typically determined by common law concepts of negligence. Negligence occurs when the driver  of a motor vehicle behaves in a manner which deviates from how a reasonably prudent person would act under similar circumstances. Here are just some of the ways that a truck driver may act negligently:

  • Negligent Operation A truck driver is negligently operating their vehicle when they are speeding, texting or in some other way failing to drive according to the prevailing conditions of the road. In particular, a number of motorcyclists are killed every year after truck drivers make dangerous left turns.

  • Dangerous Road Conditions Not every accident is entirely the fault of one driver or the other.  In many situations, a dangerous condition on the roadway could contribute to an accident – like an overgrown tree that covers up a stop sign.

  • Negligent Handling During Accident Despite what many people may believe, it’s entirely possible for a driver to be negligent in how they behave during an accident.  Truck drivers are supposed to receive training on how to avoid accidents and how to respond during an accident. But overcorrecting  continues to result in a number of accidents every year. Overcorrecting occurs when a driver grabs their vehicle and turns it in the opposite direction the car is going.

Victims of a truck accident might feel overwhelmed by what happened. In many scenarios, people will have serious injuries, high medical bills and have to miss work. Victims may be able to receive compensation for their injuries by hiring a truck accident attorney to pursue a claim for them.
