What Causes Semi-Truck Accidents?
Semi-truck accidents kill thousands of people every year in the United States. A fully loaded semi-truck can weigh as much as 80,000 lbs. Even a rear-end collision can be deadly at lower speeds. Those that survive are often left with devastating and lasting injuries. According to the Federal Motor Carrier Safety Administration, these are the primary causes of truck accidents in ascending order.
Over-the-counter drug use
Required to stop before crash (traffic control device, crosswalk)
Unfamiliarity with roadway
Traveling too fast for conditions
Prescription drug use
Traffic flow interruption (congestion, previous crash)
It’s very important that truck drivers get adequate sleep so that they can perform their job duties. But this doesn’t always happen and fatigue can set in. Truck drivers may work more hours than they are supposed to or keep a second job which interferes with their sleep. It’s important to seek the legal counsel of a truck accident attorney if you or someone that you love has been injured or killed by a truck. An attorney can take steps to investigate the facts of your case and let you know what your rights are.
Liability In Big Rig Truck Accidents
Victims of truck accidents may be able to hold multiple entities responsible after a truck collision. If the truck driver was negligent, either by being fatigued or inattentive to the roadway the company that hired them may face civil liability for the crash. Generally speaking, a company is responsible for the conduct of their employees that are acting within the course and scope of their job duties. Traffic cameras, eyewitnesses and information stored on a truck’s event data recorder all help paint a picture of what a truck driver was doing immediately prior to a crash.
A city may also face civil liability for a truck accident if it was caused by a dangerous condition in the roadway. For example, a number of cyclists are killed every year along roadways without clearly labeled bike lanes. The safety measures that should be in place along a stretch of road will be dependent on a number of factors. When there is a history of accidents along one stretch of road that puts the city on notice that there is a problem that needs to be dealt with. A truck accident attorney can investigate all factors that may have contributed to a crash and get victims compensation for their injuries.
