The driver of that truck sustained a broken femur and was taken by ground ambulance to the Loma Linda University Medical Center. Several people on the Victor Valley Transit bus had to be treated for their injuries as well.
An investigation into the bus accident remains ongoing at this point.
Liability In Bus Accidents
Buses are considered “common carriers” under the law. As such, their drivers are held to a very high standard in terms of safety. According to Acostav. Southern California Rapid Transit Dist, “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a very cautious person towards their passengers. Such carriers are responsible for any, even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.” When a bus driver is negligent, the company that they work for could face vicarious liability.
Based on a report from the FMCSA, there was at least one driver-related factor in 32% of fatal truck and bus accidents. For example, bus drivers tend to work very long hours and can easily become fatigued. Speeding, alcohol/drug use and driver distraction were also major factors as well. Those that are involved in bus accidents often sustain serious injuries including:
- Head injuries
- Back injuries
- Neck injuries
- Spinal cord injuries
Injuries from bus accidents can also be very costly. According to some medical estimates, the cost to treat a complex leg fracture can be as high as $33,000. This doesn’t include all of the indirect costs associated with an injury, like missing work. Victims of bus accidents should take a number of steps to make sure their rights are being protected.
- Get the insurance information of all parties involved in the accident.
- Seek out eyewitnesses that can help corroborate what happened.
- Seek treatment if you are injured and get copies of your medical records.
- Contact an experienced bus accident attorney that can review your case.
Victims of bus accidents can recover damages for lost wages, medical bills and pain and suffering. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case. There are statute of limitations associated with being able to file a claim, so it’s important to act quickly.
