Liability In Pedestrian Accidents
According to the NHTSA, an estimated 59,000 pedestrians are seriously injured in car accidents every year. Over 4,000 pedestrians are killed. Speeding and alcohol use remain the leading factors for pedestrian accidents. Drivers are supposed to yield the right of way to pedestrians that are lawfully within a crosswalk. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
Any person that is injured in a car accident may be able to recover damages through a personal injury claim. Pedestrians can be seriously injured in car accidents and may not even realize the full extent of their injuries until many months after the accident. According to Web MD, “at least one-third of all people involved in nonfatal accidents have posttraumatic stress disorder, persistent anxiety, depression, and phobias one year after the incident.” A car accident attorney can investigate all of the facts of your case and let you know what your options are.
