PASO ROBLES, CALIFORNIA (April 19, 2019) – Multiple people were injured in a car accident after a dump truck failed to slow down with stopped traffic on Highway 101.

The dump truck driver did not slow down enough and ended up rear-ending a Chevy Malibu. The Chula Vista man driving the Chevy Malibu was pushed into a Honda Odyssey driven by a man from Yorba Linda.
The Honda Odyssey then collided with an tree. CHP officials are saying that the Chevy Malibu continued down the road and hit a Honda-CRV driven by a person from Avila Beach.
Firefighters and paramedics rushed to the scene of the accident in order to help the victims. Several people had to be transported to the hospital with moderate to serious injuries.

Liability In Dump Truck Accidents
Nearly 4,000 people are killed every year in truck accidents. Tens of thousands more are seriously injured or disabled. A fully loaded truck can weigh as much as 10,000 lbs. According to research from the FMCSA, there are ten major factors associated with truck accidents including:
- Interruption of the traffic flow
- Unfamiliarity with roadway
- Inadequate surveillance
- Driving too fast for conditions
- Illegal maneuver
- False assumption of other road user’s actions
- Distraction by object or person inside the vehicle
Fatigue, in particular, is the single greatest factor behind truck accidents. Truck drivers are forced to work long hours and often don’t get enough sleep. There is a strong presumption of negligence following a rear-end collision. If a truck driver runs into the back of another vehicle that is fairly strong evidence they were driving too fast, distracted or fatigued.
When a truck driver is negligent and causes an accident they or the company that they work for could face civil liability. Generally speaking, companies are responsible for the negligent conduct of their employees – insofar as the employees were working within the course and scope of their employment. Commercial trucks can cause serious and costly injuries. The cost to treat even a mild traumatic brain injury (TBI) from whiplash can exceed $85,000 with severe injuries costing well over $3,000,000.
According to the Centers for Disease Control, “A severe TBI not only impacts the life of an individual and their family, but it also has a large societal and economic toll.” Victims of truck accidents can hold negligent drivers accountable through a bodily injury claim. A truck accident attorney can investigate all of the facts of your case and let you know how much you may be entitled to.
