What Causes Car Accidents?
According to the Federal Motor Carrier Safety Administration, there are numerous factors that may lead to a car accident. Driver fatigue and impairment remain serious problems. A driver can be impaired with over the counter and prescription drugs as well as alcohol. The state does not distinguish between the two and a driver can find themselves in serious trouble if they crashed while under the influence of a prescription.
Speeding regularly contributes to accidents and causes thousands of deaths every year. Even if a driver is proceeding at the speed limit this may be considered reckless depending on the road conditions. Thankfully, most intersections have traffic cameras that allow police to review what happened directly before a crash. A car accident attorney can investigate the specific facts of your case and let you know what your rights are. There are statutes of limitations associated with filing a claim, so it’s important to act quickly.
Liability In Car Accidents
Drivers have a common law duty to operate their vehicles in a reasonably safe manner in order to avoid accidents. Vans, buses and taxis are considered common carriers under the law. Those drivers are held to a very high standard and must take every precaution available to keep their passengers safe. Drivers making left turns before an accident will typically be held liable for a crash, unless they had a green arrow. According to the California Vehicle Code 21801 (a), “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.” Victims of a car accident or their family may have the ability to file a claim for damages in order to be compensated for lost wages, medical bills and pain and suffering.
