Edward Lustro Palm Springs: 34-year-old Paramedic From Rancho Mirage Identified As Edward Lustro Died In Motorcycle Accident With Honda On Gene Autry Trail
PALM SPRINGS, CALIFORNIA (March 19, 2019) – A 34-year-old paramedic from Rancho Mirage identified as Edward Lustro has died in a motorcycle accident on the Gene Autry Trail.
The Riverside County Coroner’s Office says that the accident took place shortly after 8:30 a.m. not far from Dinah Shore Drive. His body was covered in an American flag as he was taken away from the scene.
A dozen emergency responders paid tribute with salutes as authorities continued to investigate. It remains unclear how the collision between Edward Lustro and the Honda took place.
Liability In Motorcycle Accidents
According to the FMCSA nearly 35,000 drivers are killed every year in car accidents. Motorcycle riders are particularly at risk. Motorcyclists have a very low profile and are much more likely to be involved in left turn collisions and side-swipe collisions. According to the California Vehicle Code 21801:
“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
But driver error is not the only cause of accidents. A number of collisions are caused by poorly maintained or otherwise dangerous roads. Under California Code of Civil Procedure 835, a city may be liable for a “dangerous condition on public property.” A road or intersection may be dangerous if they lack basic safety features or have an obscured line of sight. A wrongful death attorney can examine all of the unique facts of your case and let you know what your options are.
