Oxnard Forklift Accident: Man Killed In Oxnard Forklift Accident Near South Rice Avenue
OXNARD, CALIFORNIA (July 12, 2019) – A construction worker was tragically killed in a forklift accident by South Rice Avenue.
Oxnard police are saying that the accident took place around 3:45 p.m. The forklift involved in the accident rolled over the victim.
Firefighters and paramedics were called to the scene in order to help the victim. Despite life-saving efforts they later succumbed to their injuries.
Cal/OSHA are currently investigating the incident. The identity of the construction worker that died remains unknown at this point.
Liability In Forklift Accidents
Thousands of construction workers are killed or seriously injured in accidents every year. Many of these accidents involved heavy machinery like forklifts. A forklift is naturally top-heavy and therefore prone to tipping over. It is therefore no surprise that Forklift rollovers are among the most common types of accidents. Rollovers can be due in part to:
- Improper turning
- Driving with an elevated load
- Excessive speed
There are a number of safety measures that can be taken to help reduce the likelihood of accidents. SAS (System of Active Stability) with AMC (Active Mast Control) can help reduce the likelihood of rollovers. Adequate training is also extremely important. Companies must train their employees on how to handle heavy equipment.
If a worker is injured on the job their employer is required to give them benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This includes death benefits in the event that a worker is killed. In addition to workers compensation, the family of a deceased worker may be able to recover damages through a wrongful death claim.
If an entity separate from a worker’s employer was responsible for an accident they could be held liable through a civil claim. Damages can help cover medical bills, funeral expenses, lost wages and emotional trauma. A wrongful death attorney can examine all of the facts of your case and let you know if there are potential sources of third party liability.
