OXNARD, CALIFORNIA (October 8, 2018) A 60-year-old bicyclist identified as Jose Reyes has tragically died in a bus accident by Gonzales Road and Lantana Street according to the California Highway Patrol.

Oxnard police are saying that Jose Reyes was riding his bicycle on the bike lane and began moving into the street. A Gold Coast Transit bus moving in the same direction struck the victim and knocked him over.

The bicycle accident took place around 4:13 p.m. Police immediately rushed to the scene along with emergency medical workers. Gonzales Road was blocked off for some time as an investigation into the bus crash was underway.

A video of the aftermath of the collision shows the bicycle laying in the middle of the road along with clothes. The back end of the tire was badly damaged and bent.

Jose Reyes was transported to the Ventura County Medical Center in Ventura in order to receive treatment but he was later pronounced dead.

What To Do After A Bus Accident

There are a number of things that police will want to examine when they investigate the bus accident that killed Jose Reyes. A bus accident can be particularly devastating especially for pedestrians. It has been estimated the nearly 5,000 people are killed every year in accidents involving buses and trucks. In order to preserve your rights after an accident there are a number of important steps that you should take:

  1. Get the proper medical care for your injuries. Receiving treatment helps establish the full extent of your injuries. In many circumstances when an accident victim doesn’t receive treatment or waits to receive treatment an insurance company will use this to downplay the extent of your injuries.

  2. Take the time to preserve any evidence related to the accident. Take pictures of the accident scene and of any injuries that you sustain. Collect the information of all parties involved and of anyone that may have seen what happened.

  3. Call the police. It’s important that the police thoroughly document and investigate the crash.

  4. Seek the advice of an experienced bus accident attorney. A bus accident attorney can investigate your case and take steps to preserve key pieces of evidence. Bus companies will work hard to deny liability and downplay the extent of your injuries.

Victims of  bus accidents may have the ability to file a claim for damages including lost wages, medical bills and pain and suffering. A Los Angeles bus accident attorney can give you a free consultation and let you know if you have a claim that can be pursued.

Liability In Bus Accidents

A number of laws will apply to the bus accident that killed Jose Reyes. Bus accident laws are governed under common carrier law. A common carrier is a company that offers transportation services to the general public. A common carrier can be either a private company or part of a government agency. Common carriers are typically held to a higher standard than other drivers. A bus driver may be negligent if they were speeding or not paying attention before an accident.

One of the things that makes buses different from other vehicles is the fact that they have substantially larger blind spots. A number of crashes occur when the driver fails to notice a bicyclist moving into their lane. There may also be sources of negligence outside of the driver. A lack of proper maintenance on a bus may very well contribute to a crash. Depending on the facts of any case a victim or their family can pursue a personal injury claim against the employer of the bus driver.
