Liability In Car Accidents
All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
Animals and pedestrians can both be very unpredictable. This is why drivers should reduce their speed when passing. It’s best to stay as far away as possible. If a driver is negligent and contributes to an accident with a horse they may face civil liability. If the driver was working at the time of the accident the company that they work for may face civil liability as well. Companies are generally responsible for the negligent conduct of their employees – insofar as those employees are working within the course and scope of their job duties.
The family of any victim that died in a car accident may have legal recourse under California Code of Civil Procedure 377.60. Potential claimants in a civil matter may include the victim’s parents, siblings, spouse and children. Damages can help cover lost wages, medical bills, funeral expenses and emotional trauma. A car accident attorney can examine all of the facts of your case free of cost and let you know what your options are.
